“It is essential to international commercial relationships that potential disputes can be resolved efficiently and that judgments and arbitral awards should be enforceable. The Brussels I Regulation, which ensures the free circulation of judgments within the EU, was recently revised and one of the main issues during the revision was whether the Regulation affects the efficient resolution of international commercial disputes in the Union through arbitration. The thesis sets out to ascertain whether the Regulation constitutes a legal problem with regard to international commercial arbitration in the Union, and to what extent this legal problem should be addressed in Union law. The thesis investigates the interface between the Regulation and international commercial arbitration; it analyses the consequences of this interface; and suggests ways to address these consequences within the Union. “
