New article on the Danish Unternehmergesellschaft

The article clarifies the legal status of “iværksætterselskabet” in Denmark, as it will be when Act No. 616 of 12 June 2013 comes into force. The article focuses on the characteristics that distinguish the IVS from the other private limited companies. The German rules on Unternehmergesellschaft (haftungsbeschränkt) have been consulted in order to clarify the differences and similarities between the two variants of the private limited company. In addition, the German rules and the academic debate in Germany regarding Unternehmergesellschaft (Haftungsbeschränkt) has been involved, in order to point out the discrepancies in the Danish law, and to some extent to provide interpretations of the legal status of the Danish IVS.
