PhD defence: Vishv Priya Kohli
The doctoral study identifies that the problem of counterfeiting and falsification of medicinal products in the EU lies at the intersection of Intellectual Property law, Medicine law and Criminal law. Three case studies are employed to illustrate the mutually exclusive and compartmentalised approach that is employed by the three streams of law while addressing counterfeiting and falsification of medicinal products. The legal analysis reveals that the legal framework does not operate at the most effective level possible.
