Research project: Reformation or Deformation of the EU Public Procurement Directives

The research project aims to assess to what extent the new EU public procurement rules in Directives 23, 24 and 25 of 2014 are an improvement on previous generations of EU Directives and whether they stick to the EU case law they aim to codify, or distort it. It adopts an interdisciplinary law and political science approach and particularly focuses on the origin of the legal reforms and the legislative process at the EU level that led to their adoption. Within the framework of political science studies on quality of regulation and EU law-making, the research critically assesses the 2014 public procurement rules and their fit with the preexisting EU case law as a proxy for the success of their future enforcement. It provides a novel interdisciplinary perspective on the development of public procurement law and aims to fill a gap in European regulation studies. The project brings together 17 academic experts in EU decision-making and public procurement, each tasked with the analysis of a specific provision of the 2014 public procurement rules.
